The Criminal Court has sentenced a 47-year-old Filipino resident to 15 years in prison for the repeated sexual abuse of his daughter between the ages of four and ten. The Superior Court notified the ruling, which holds the man accountable for a major continued offence of sexual acts constituting rape against a minor under 14 by an ascendant, a major continued family-based sexual aggression offence, and a minor domestic mistreatment charge against a minor. No significant modifying circumstances affected his criminal responsibility.
The court found the abuse proven as repeated acts over roughly six years in the family home, exploiting the father's position of authority, cohabitation, and the trust inherent in the parent-child relationship. Judges gave full credibility to the victim's coherent and persistent testimony, reinforced by psychological and expert reports from the investigation. They highlighted the girl's vulnerability at the time and the emotional harm caused, which informed the penalty.
Prosecutors won the full 15-year sentence they sought during the closed-door trial on 12 and 13 January, dismissing the defence's request for acquittal or reclassification as mere mistreatment due to alleged doubts. The court applied standard penalties under current legislation, without notable mitigators or aggravators.
Additional measures include a 12-year ban on approaching or contacting the victim, removal from parental authority, custody, guardianship, and visitation rights until she turns 18, and deportation from Andorra for 20 years after serving the sentence. The man must pay €15,000 in compensation for moral damages and cover court costs.
The case emerged in April 2024 when the girl, then 15, disclosed the abuse to trusted people, prompting a police report. Officers arrested the father at dawn on 30 April after his restaurant shift and held him in pre-trial detention due to the severity of the allegations. He denied the claims and declined to testify, but evidence of a highly conflictual relationship supported her account.
The defence plans to appeal to the Superior Court for a reduced sentence.
