Andorra Social Democrats Press Government on Tenant Protections After Court Ruling

Pere Baró will ask the executive how it plans to shield renters after a Superior Court ruling required tenants to explicitly request rental extensions under Law 24/2023.

Key Points

  • Social Democrats will table an urgent oral question on tenant protections in Andorra.
  • Pere Baró seeks clarity on legal certainty and alternatives after the court interpretation of Law 24/2023.
  • The Superior Court held that tenants must explicitly request an extension for protections to apply.
  • The party says housing access remains a top public concern while respecting judicial independence.

The Social Democrats will press the government on what it intends to do to protect tenants following a judicial interpretation of Law 24/2023 on measures to stimulate and stabilise the housing rental market, the party has said.

Pere Baró, a general councillor for the group, will put an urgent oral question to the executive seeking to establish the consequences for tenants' legal certainty and the alternatives the government is studying to prevent them from being left unprotected.

The party reiterated that the initiative respects the separation of powers and is aimed at finding possible solutions within the legal framework to preserve the residential stability of affected families.

At issue is the application of the legislation, approved on 28 November 2023, after a Superior Court ruling held that tenants must explicitly request an extension for it to take effect. The Social Democrats say that reading raises questions about how the law's protections are being applied in practice.

The party has framed the move against the backdrop of housing access remaining one of the public's main concerns, and maintains that respecting judicial decisions and addressing their potential social consequences are entirely compatible positions.
