Spanish Man Charged in Andorra for Threatening, Harassing Police While Breaching Night Arrest

A 40-year-old Spanish man faced charges in Andorra's Tribunal de Corts on Wednesday over an August 2022 incident near the Runer river border, where he threatened and harassed Mossos d'Esquadra officers while intoxicated and breaching a night arrest sentence.

The man, serving a 12-month night arrest imposed in October 2021 at the La Comella penal centre, had arrived late on 13 and 15 August and failed to report from 16 to 18 August. Officers located him walking toward Andorra in an intoxicated state on 18 August and attempted to escort him back. He responded with aggression, shouting insults like "shitty police, corrupt sons of bitches, cock-suckers" and death threats including "when they remove the handcuffs, I'll smash you" and "your mother will have to visit you in the cemetery, faggot, I'll kill you."

He also directed sexual remarks at a female officer, such as "you little girl, whatever I can do to you, I'll rip your ass open and fuck you, you're so pretty." Officers described him as "out of control, violent, euphoric," kicking the patrol car partition and attempting a headbutt on one agent during transfer. The female officer testified that "this isn't something you forget," calling the situation "very complicated" due to his "unrestrained, aggressive" behaviour. Fearing for their safety, they noted prior encounters where he displayed similar "aggressive, disrespectful" attitudes.

La Comella staff refused admission due to his drunkenness, prompting a hospital transfer with a second patrol and ambulance support. He continued resisting en route, calming only after sedation at the hospital.

In court, the defendant, with prior alcohol- and drug-related convictions, said he blacked out after drinking and using cocaine in La Seu d'Urgell, remembering nothing. Expressing remorse, he stated: "I'm still sorry today, it's shameful—it wasn't me, it was the demon that takes over when I drink alcohol." He described himself as "sick," undergoing mental health treatment including psychologist and psychiatrist sessions post a suicide attempt involving 200 pills, and claimed four years' sobriety while in rehabilitation. He added he has a daughter and is "trying to get out of this hole" but loses control under the influence.

Prosecutors seek 20 months' firm prison for continued minor breach of sentence, serious resistance and disobedience to authority, cocaine use, unconditional threats, and minor sexual harassment. The defence requests only the served portion as firm, with the rest conditional on treatment compliance.

The hearing was suspended pending further witnesses, including medical staff and an evaluating doctor who could not attend. A new date is pending.
