Amb Seny Seeks to Nullify La Massana Viewpoint Project's Public Period Over Missing Online Access
Opposition group Amb Seny in La Massana demands the public information period for the Alt de la Capa viewpoint be annulled due to absent electronic access to essential documents, violating Andorran environmental law.
Key Points
- Amb Seny petitions La Massana council to void public info period for Alt de la Capa viewpoint.
- Cites violation of Law 4/2023 requiring online access to project docs and environmental studies.
- Current access limited to in-person visits by appointment, no electronic options provided.
- Councillors report lacking full access; group prioritizes transparency and citizen input amid controversy.
The opposition group Amb Seny in La Massana has formally requested the annulment of the public information period for the Alt de la Capa astronomical viewpoint project in Arinsal, arguing that the process fails to meet legal requirements for electronic access to key documents.
In a petition to the communal council, the minority group claims the edict issued on 2 October and published in the Butlletí Oficial del Principat d'Andorra (BOPA) on 7 October contravenes Article 8.6 of Law 4/2023 on environmental assessment. That provision mandates that project details, the environmental impact study, and the preliminary impact report be made available not only via BOPA but also through electronic means during the one-month consultation period.
Access to the materials is currently limited to in-person visits at communal offices by prior appointment, with no online mechanism outlined in the edict. Amb Seny argues this setup limits public scrutiny and equal participation, particularly amid ongoing citizen debate over the viewpoint's potential effects on the local landscape and environment in the Alt de la Capa area.
Councillors Guillem Forné and Laura Bragança report that even they lacked full access to the environmental files before the period opened, despite the council's assurances of transparency. The group is pushing for the current process to be voided and replaced with a new one ensuring comprehensive online availability.
"No amount of repeated assertions that a project has been handled transparently will suffice," Amb Seny stated. "Transparency must be proven through actions, by providing access to all information and strictly following legal procedures and protections."
The request comes as the commune opened the 30-day window for reviews and allegations, against a backdrop of public controversy surrounding the project's territorial implications. Amb Seny stresses that safeguarding land, upholding the law, and enabling citizen input should take precedence over advancing the initiative.
