Andorra Approves Police Firearms Regulation to Prevent Abuse

Andorran government has enacted a 15-article rule developing police law on firearms and coercive measures. It ensures use only in grave situations under strict principles like proportionality, with training and oversight to protect rights and safety.

Key Points

  • Regulation details possession, carrying, and use of firearms by police.
  • Permitted only for serious risks to life, integrity, or public safety with proportionality.
  • Requires mandatory training, weapon prohibitions, and force incident reviews.
  • Aims to enhance legal security for citizens and officers while upholding rights.

The Andorran government approved a regulation on Friday detailing the possession, carrying, and use of firearms and authorised coercive measures by police officers, aiming to prevent any improper or abusive application.

The 15-article document develops provisions in the Qualified Law on the Police Corps. It acknowledges that such tools can be essential in certain situations to protect people's integrity, public safety, and officers themselves. However, firearms are permitted only when there is serious risk to life or physical integrity, or to public safety, and must follow principles of congruence, timeliness, and proportionality.

The regulation outlines conditions for mandatory and ongoing officer training, cases for temporarily prohibiting weapon carriage, and obligations to register, monitor, and review every instance of force. These measures seek to bolster legal security for both citizens and police while prioritising safety and efficiency.

The approval came with a favourable report from the Police Council, underscoring the government's commitment to providing the force with a modern regulatory framework that enables effective operations while upholding rights and freedoms.
