Andorra Court Convicts Two Nightclub Guards of 2018 Assaults

Andorra's Criminal Court has convicted two nightclub security guards of minor intentional injury offences stemming from an altercation outside a discotheque on St. John's Night in 2018.

The incident unfolded in the early hours of 24 June 2018, when security staff expelled an intoxicated young man from the venue. The verbal dispute escalated into a physical confrontation involving the ejected man, his partner, and his brother, resulting in injuries to all three.

Judges ruled the facts proven based on consistent victim statements and medical evidence showing injuries compatible with the alleged assaults. The lead accused, who targeted both the initial victim and his partner, received five months' conditional night arrest and a 3,000-euro fine. He must pay 2,360 euros in compensation to one victim, 1,211 euros in civil liability to another, and 219.48 euros to the Andorran Social Security Fund (CASS).

The second guard, responsible for injuries to the third victim, was sentenced to three months' conditional night arrest and a 1,000-euro fine, plus 1,211 euros in civil liability and 233 euros to CASS.

Prosecutors presented the case nearly eight years after the event. Defences denied any assault, arguing the injuries were minor, required no medical treatment, and amounted to time-barred misdemeanours. The court rejected these claims, attributing greater responsibility to the first guard due to his more active role.

The trial concluded that a verbal exchange between clients and security staff turned physical, with both guards participating to varying degrees. All sentences are suspended, subject to compliance.
